Understanding the Divorce Process in Texas – A Quick Overview

When you file for divorce in Texas, there are three essential documents that must be submitted to your county court to officially begin and complete the process. Knowing these documents and the timelines associated with them is the first step toward a smooth divorce experience.

✅ The Divorce Petition: Starting the Clock

The divorce process officially begins when one spouse files the Divorce Petition. This petition is a formal request to the court to dissolve the marriage. Filing this document sets a mandatory waiting period of 60 days before the divorce can be finalized. This waiting period is designed to allow time for both parties to work through the details of their separation, including child custody arrangements and asset division.

✅ Response from the Other Spouse: Waiver of Service or Answer

After the petition is filed, the other spouse must respond by either filing a Waiver of Service or an Answer to the Curt. This response must be submitted within 20 days plus the following Monday after the petition is filed. Importantly, this response cannot be filed on the same day as the petition. The waiver of service indicates that the spouse acknowledges receipt of the petition and agrees to proceed without formal service, while an answer allows them to respond to the claims made in the petition.

What Happens During the Waiting Period?

The 60-day waiting period is often longer in practice, as this is the time when the real work of divorce takes place. During this phase, couples must make important decisions that will impact their lives moving forward.

✅Child Custody and Support Decisions

If you have children under the age of 18, one of the most critical issues to resolve is how custody and visitation will be handled. You’ll need to decide how to split time with your children and determine the primary parent. These decisions directly influence the calculation of child support, which is a financial obligation designed to ensure the children’s needs are met post-divorce.

✅Division of Assets

Texas is a community property state, meaning all assets acquired during the marriage are generally considered communal and must be divided fairly. This includes real estate, bank accounts, retirement funds, and other valuables. Deciding how to split these assets can be complex and often requires careful negotiation or mediation to reach an agreement that satisfies both parties.

The Divorce Decree: Finalizing Your Divorce

Once all decisions regarding child custody, child support, and asset division have been made, these details are put into the Divorce Decree. This is the final document that outlines the terms of your divorce and is submitted to the court for approval.

The court reviews the decree, and on the day it is signed, your divorce becomes official. This date marks the legal end of your marriage.

Important Legal Details About Divorce in Texas

  • Residency Requirements:
  • At least one spouse must have lived in Texas for six months and in the county of filing for at least 90 days prior to filing.
  • No-Fault Grounds:
Most Texas divorces are filed on “no-fault” grounds, meaning neither party has to prove wrongdoing—simply that the marriage has become insupportable.
  • Contested vs. Uncontested Divorce:
If spouses agree on all terms, the process is typically faster and less costly (uncontested). Disagreements (contested divorce) may require mediation or court hearings.
  • Temporary Orders:
During the waiting period, either spouse can request temporary orders for child support, custody, or use of property to ensure stability until the divorce is final.
  • Modifying Orders:
After the divorce, child custody, support, or visitation orders can be modified if circumstances change.
